For example real estate development project we check permits, licences and titles are all in place. This is what we call the ‘Due Diligence’ process. Our ‘Due Diligence’ process is probably the most extensive carried out. In case of real estate project we only work with reputable developers who are able to provide us with all the necessary documentation. Our client’s money is of the highest importance to us and we want to maintain its security with 100% delivery.

Some of the typical checks we carry out in real estate new development are listed below:

  • Building Licences
    A document proving that the developer has obtained the licence that allows the construction of the project to start.
  • Certificate of Land Ownership

  • Planning Approvals
    We check with local planning departments to see what applications have been approved and those pending approval. This helps to understand how the location in question will develop in the near future.
  • Non-Encumbrance Check
    Searches to find out whether or not there are any debts secured against the land or property.
  • Build Quality Guarantees
    A guarantee relating to the quality of construction and specification.
  • Developer Background Checks and References
    Full checks on developer’s background and experience. We also carry out on-site inspection of previous projects and speak with previous customers.
  • Preliminary Contract
    When you purchase an off-plan property you will be required to sign a ‘Preliminary Contract’. We will review these to make sure that the terms are fair.
  • Bank Guarantee
    A guarantee stating that if the developer runs out of funds prior to the completion of a development project, the bank or insuring party will return all funds to the investor.   • Stage Payments to Developer
    Review of the stage payment percentages and to whom this payment is made. Wherever possible we look to have our clients monies deposited into a separate client account (escrow) which is administered by an independent lawyer.
